The information and content ("Content") on our online and mobile websites, platforms, services, and applications is for your general information only. By using our Healthfirst Websites, you agree to the most-recent Terms as well as the most-recent version of our Privacy Policies. If you enter into any other agreement with Healthfirst, for example an agreement for health plan coverage, benefits, or online payment portal, then these Terms are in addition to the terms of such other agreement and in the event of any conflict, the terms of the other agreement control.

User IDs

The Healthfirst Websites may allow you to register by providing a user name/email address and password ("User ID"). These are your credentials for accessing portions of the Healthfirst Websites. You are responsible for protecting your User ID. If your User ID or other activation codes you use with the Healthfirst Websites are compromised, you agree to immediately inform us.

Content Ownership

All rights, title and interest in and to the Healthfirst Websites, including the Content, and all intellectual property rights, including all copyright, trademark, patent and trade secret rights therein shall remain with the Healthfirst and our licensors and vendors, and no ownership interest is transferred to you or any other entity by virtue of making the Content available on the Healthfirst Websites. Use of Mobile and SMS

Receive special text notifications from Healthfirst through your mobile device. Text JOIN to 29285 to receive up to 4 text messages per month. Message and data rates may apply.

By opting in to this service, you consent to receive mobile text alerts using an automatic telephone dialing system or manually. Consent to receive health-related services or marketing text messages is not required as a condition of enrolling in any plan or services. By signing up, you are confirming you are over the age of 18.

Accuracy of Information Provided.

We may use a number of different sources (such as information provided by you, your health insurance carrier, or information we obtain from other data sources available to us) to display information that we believe may be relevant to you or your search query.



Use of the Healthfirst Websites in no way increases or decreases the benefits under your health insurance plan. Your coverage documents will control in the event of their inconsistency with the information on Healthfirst Websites.


RULES OF PARTICIPATION

GENERAL RULES

1. The Healthfirst Member Community is operated by a third party ("Sponsor") on behalf of Healthfirst. These Rules apply whenever you access the https://healthfirstmembercommunity.org website, regardless of the method or device used. In these Rules, when we say "Healthfirst Member Community" "Panel" "Community" or "Website," we mean this site, https://healthfirstmembercommunity.org regardless of how you access it. Any reference in this Agreement to "Healthfirst Member Community" "us" or "our" means Healthfirst or a third party on behalf of Healthfirst.

2. The existence and use of this Panel shall be at the sole discretion of Healthfirst. Healthfirst expressly reserves the right to limit, edit or remove images, text or other content from this Panel for any or no reason, in their sole discretion, without accepting any obligation to do so. Healthfirst also reserves the right to cancel any member's registration, and/or to remove any materials related to or posted by such member, without notice or cause, in their sole discretion.

3. The images and/or text displayed or posted on this Panel do not necessarily reflect and should not be considered as the views of Healthfirst.

4. All information you provide, including personal information, belongs to Healthfirst and may be used by them for any commercial or non-commercial purpose permitted by law, without restriction or payment to you. Please review our Privacy Policy at https://bit.ly/2Ud2ICy for information on how Healthfirst will handle your personal information.

5. No one under 18 may become a member of this Panel.


HEALTHFIRST MEMBER COMMUNITY RULES

8. You may not upload or post images, text or other content (hereafter "User Content") at https://healthfirstmembercommunity.org that:

(a) is defamatory, abusive, harassing, insulting, threatening, or that could be deemed to be stalking or constitute an invasion of privacy of another person

(b) is bigoted, hateful, or racially or otherwise offensive, violent, vulgar, obscene, pornographic or otherwise sexually explicit

(c) is or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them;

(d) infringes or violates any right of a third party or any domestic or international law, rule or regulation including, but not limited to: (i) copyright, patent, trademark, trade secret or other proprietary or contractual rights; (ii) right of privacy (specifically, you must not distribute another person’s personal information without their express permission) or publicity; or (iii) any confidentiality obligations;

(e) contains any software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment; or
(f) contains any advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or promote illegal activity and/or illegal contests, sweepstakes, gambling, including any online casino, sports books, bingo, poker or any other form of solicitation

9. By uploading content and/or images, you warrant that a) you are the author/creator; b) you have taken the photograph(s) you have sent to us or you have permission from or are authorized by the owner and/or author of the photograph(s) to send it (them) to us; c) pictures or images of any other third party were taken with their permission and knowledge; and d) the pictures or materials do not infringe the intellectual property or publicity rights of any other person or entity.

10. By uploading User Content, you recognize that such User Content will be publicly available, that others may copy or redistribute such User Content, and that Healthfirst has no control over such use.

11. Any attempt to damage, destroy, or tamper with this Website and/or Panel is a violation of criminal and civil law. Sponsors reserve the right to prosecute violators to the fullest extent of the law.

12. By uploading User Content, you agree that you have read and understood these Rules and agree to abide by them. Violations of our community rules will, at our discretion, result in removal of the offending User Content from the Panel, expulsion from membership, and/or initiation of legal action to enforce this Agreement, including, but not limited to, seeking the assistance of law enforcement personnel.

13. You understand and acknowledge that any User Content is only the opinion of the poster, is no substitute for your own research, and should not be relied upon for any purpose.

14. You are solely responsible for the content of any postings you submit and Healthfirst assumes no responsibility or liability for any content submitted by you or any other website visitor.
15. If you do post content or submit material, and unless we indicate otherwise, you grant Healthfirst a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Healthfirst and any of its sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this Agreement and will not cause injury to any person or entity; and that you will indemnify Healthfirst or its affiliates for all claims resulting from content you supply.

EARNING AND REDEEMING POINTS RULES

16. Solely in consideration for the exchange of responses, opinions, and reactions to the Community, and participating in various surveys, live chats, and discussions with other participants in the Community, and for no other purpose(s) whatsoever, whether express or implied, Healthfirst will award points to Members solely on the following basis:

(a) Member is a legal resident of the New York state.

(b) Member is enrolled in a Healthfirst plan at the time of redeeming points in exchange for digital gift cards.

(c) Completion of any particular activity may yield a specified number of points. Points awarded (if any) for any individual activity will be specified on the Community prior to participation.

(d) Points may be redeemed for gift cards, as described in the Community. Healthfirst collects no fee or payment information of Members to redeem gift cards.

(e) Points will be automatically assigned by the Community upon Member’s completion of any particular activity (points will be reflected in a Member’s account within 24-48 hours of completion).

(f) Points can be redeemed directly through the Community via Giftbit. Giftbit manages the disbursement of the digital gift cards Members choose to redeem with points earned. Gift card amounts may vary. Members may choose to automatically redeem their points as they’re acquired, or stock pile points to redeem for larger gift card amounts at a later time. At least 5 points will be needed to redeem a gift card, and gift cards will be available in denominations of $5 USD.

17. All Members are be responsible for (i) any and all costs associated with their gift cards, including but not limited to the payment of any taxes, fees, and withholdings to any federal, state or local tax authority, and (ii) filing any required reporting documentation associated with their gift cards. Members should consult their tax advisor.

ADDITIONAL TERMS

18. The laws of the State of New York govern the Agreement and any cause of action arising under or relating to your use of the website, without reference to its choice-of-law principles. You agree that the only proper jurisdiction and venue for any dispute with Healthfirst relating to your use of this website, is in the state and federal courts in the State of New York. You further agree and consent to the exercise of personal jurisdiction in these courts in connection with any dispute relating to your use of this Website. Before seeking legal recourse for any harm you believe you have suffered arising from or related to your use of this Website, you agree to inform us in writing and to give us 30 days to cure the harm before initiating any action. Healthfirst reserves the right to pursue any available remedy if you breach any provision of this Agreement, and may enforce these Rules by any available means at law or equity. If any provision of the Agreement is found to be void, unlawful or unenforceable for any reason, that portion shall be deemed severable from these terms and shall not otherwise affect the validity and enforceability of any remaining provisions. No waiver of any of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
19. YOU AGREE THAT NONE OF HEALTHFIRST, INC. NOR HF MANAGEMENT SERVICES, LLC, NOR ANY OF THEIR RESPECTIVE SUBSIDIARIES AND AFFILIATES (THE “HEALTHFIRST PARTIES”), SHALL BE LIABLE FOR ANY DAMAGE RESULTING FROM YOUR USE OR INABILITY TO USE THIS WEBSITE OR THE CONTENT. THIS PROTECTION COVERS CLAIMS BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, AND ANY OTHER LEGAL THEORY. THIS PROTECTION COVERS THE HEALTFIRST PARTIES, INCLUDING ALL AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS. THIS PROTECTION COVERS ALL LOSSES INCLUDING, WITHOUT LIMITATION, DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, AND PUNITIVE DAMAGES, PERSONAL INJURY/WRONGFUL DEATH, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION. THE TOTAL, CUMULATIVE, LIABILITY OF THE HEALTHFIRST PARTIES, INCLUDING ALL AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, IF ANY, FOR LOSSES OR DAMAGES SHALL BE LIMITED TO THE AMOUNT OF YOUR ACTUAL DAMAGES, NOT TO EXCEED U.S. $100.00. IN NO EVENT SHALL THE HEALTHFIRST PARTIES, INCLUDING ALL AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, BE LIABLE TO YOU FOR ANY LOSSES OR DAMAGES OTHER THAN THE AMOUNT DESCRIBED ABOVE. ALL OTHER DAMAGES, DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE, RESULTING FROM ANY USE OF THE WEBSITE OR CONTENT ARE EXCLUDED EVEN IF THE HEALTHFIRST PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT YOU USE THIS WEBSITE AT YOUR OWN RISK. IF YOU ARE DISSATISFIED WITH THIS WEBSITE OR THE CONTENT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE WEBSITE.
20. The Effective Date of the Rules is May 1, 2019.
